Fire Department Protected With Stay Away Order
An individual with a history of confrontation with police was repeatedly harassing members of a city fire department. He confronted a fire engineer at a station house with verbal abuse, used an emergency phone outside of a station house to swear at fire department employees, and flagged down a fire engine and yelled and swore at the fire engine crew.
Criminal charges were also pending against the individual for battery and assault on peace officer/emergency personnel. The District Attorney’s Office was contacted in an effort to secure a “stay away order” as part of any terms of probation entered in the criminal cases.
Through cooperation between the City Attorney’s Office and the District Attorney’s Office, the final disposition of the criminal cases included as a condition of three years of probation an order by the Court to remain 100 yards away from members of the fire department as well as fire department property, with the exception of a legitimate need for emergency services.
City Hall Protected With Workplace Violence Prevention Restraining Order
Shortly after this stay away order was secured for a fire department, another city experienced a disgruntled code violator who showed up at city hall and assaulted a city employee. The police department escorted the individual off of city property, but he came back as soon as the police left.
This time the individual would not leave and became confrontational with the police officers who were called back to city hall. He was arrested and subsequent criminal charges were filed against him for battery on an officer, disturbing the peace and resisting arrest.
A Petition for a Workplace Violence Prevention Restraining Order was filed with the Court. The matter was concluded in February, 2013 with the issuance of a Stay-Away Order against the individual to remain at least 100 yards away from City Hall and the employee who was assaulted.
