Why receiverships and administrative hearings matter for code enforcement

Most code cases are resolved with a notice and a conversation. Some aren’t. When a property owner won’t cooperate, or a property has become a danger to its neighbors, cities need tools that produce results.

Administrative hearings give cities a way to enforce local codes and impose penalties without going to court. California law, including Government Code section 53069.4, allows cities to adopt administrative citation and penalty procedures. They can be faster and less costly than criminal prosecution or civil litigation, but they work only when notices, procedures and records hold up to review. Jones Mayer also provides hearing officer services to public agencies.

Health and safety receiverships go further. Under Health and Safety Code section 17980.7, a court can appoint a receiver to take control of a substandard property and bring it into compliance when the owner will not. Receiverships can turn a long-standing nuisance into a safe, habitable property. Learn more in our article, Health and Safety Receiverships Can Be Powerful Enforcement Tools, and our update on recent amendments to Health and Safety Code section 17980.

Used together, these tools can help cities address blight, protect neighborhoods and resolve the cases that have resisted every other approach.
