Health & Safety Receiverships


Jones & Mayer is one of the leading law firms specializing in Health & Safety Receiverships across the State. Authorized by the California Health & Safety Code, a Receivership is an immediate judicial remedy that virtually eliminates emergency health and safety housing threats in your community. Upon nomination by the local enforcement agency, a court appointed officer, the Receiver takes temporary custody of title to a property posing imminent threats to either the occupants or surrounding community and is charged with the duty of bringing that property into compliance with State and local codes all at the property owner and property’s expense.

Receiverships for severely substandard properties are quickly emerging as the future of code enforcement across the State.

Benefits of the remedy include: the ability to present an emergency application and obtain appointment of receiver within 72 hours of discovery of threat; mandatory recovery of attorney's fees and costs to prevailing party; coordinating resources and obtaining funding to perform required work; and visibly communicates dramatic efforts to rehabilitate neighborhoods. Orders to vacate come from the supervising court, and property clean-outs, rehabilitation or demolition are supervised by The Court and performed by The Receiver.

Sample cases qualifying for consideration of this remedy include: "packrat" and hoarder properties, disabled owners/occupants unable to comply with abatement orders, police and fire referrals, forced tenant and/or owner relocation, illegal construction or occupation, multi-unit/apartment complex cases, fire damaged properties, slumlord/deceased owner and/or trust owned properties, bank owned/abandoned properties and many more. Jones & Mayer offers services, expertise and a team of professionals unique to any other law firm in the State in that our Receivership Division routinely provides legal representation to public agencies in obtaining the appointment of receivers. Alternatively, if the public agency wishes to use its own legal counsel we can, and are, routinely nominated by Cities and Counties to serve as the Court Appointed Receiver.
