The article offers James’s thoughts on the challenges facing law enforcement agencies in a time of unprecedented strain. State and local directives aimed at limiting the impact of the pandemic have raised numerous legal issues that have rarely come before courts. Without settled guidance on how to balance the state’s emergency orders with Constitutional rights, agencies and officers must navigate a complex patchwork. Mounting political pressure to undermine important protections like qualified immunity further reinforce the need for careful planning, training and management to achieve the law enforcement profession’s goals within its communities.
